THERE HAS BEEN RECEIVED IN OUR OFFICE, BY REFERENCE FROM THE DEPARTMENT OF THE ARMY, YOUR LETTER DATED DECEMBER 21, 1955, AND ENCLOSURES, REQUESTING INFORMATION AS TO THE STATUS AND MERITS OF THE CLAIM OF DR. FRANCISCO Y. MANIGBAS, BAUAN, BATANGAS, REPUBLIC OF THE PHILIPPINES, FOR DAMAGES TO HIS PROPERTY AS A RESULT OF THE USE AND OCCUPANCY THEREOF BY THE DEPARTMENT OF THE ARMY, UNDER LEASE NO. W 2570 ENG. B-449, DATED SEPTEMBER 5, 1945.

THE OFFICE OF THE CHIEF OF FINANCE, DEPARTMENT OF THE ARMY, FORWARDED DR. MANIGBAS' CLAIM TO US ON SEPTEMBER 25, 1951, FOR DIRECT SETTLEMENT. SETTLEMENT OF OUR OFFICE DATED NOVEMBER 21, 1951, THE CLAIM WAS ALLOWED IN AN AMOUNT OF P. 3,800 (PHILIPPINE PESOS), AND DISALLOWED IN THE AMOUNT OF P. 76,733.20. THE DISALLOWANCE WAS PREDICATED UPON THE FACTS OF THE CASE AND RECOMMENDATION APPEARING IN A REPORT FROM THE CHIEF OF FINANCE. THE REPORT, IN SUBSTANCE, DISCLOSES THAT THE AMOUNT OF P. 3,800 RECOMMENDED FOR PAYMENT, REPRESENTS A FAIR EVALUATION OF THE DAMAGES TO THE PROPERTY COVERED BY THE LEASE, ASCERTAINED BY A FAIR AND IMPARTIAL APPRAISAL.

UNDER DATE OF NOVEMBER 30, 1955, WE RECEIVED A LETTER, WITH ATTACHMENTS, FROM DR. MANIGBAS, QUESTIONING THE ADEQUACY OF THE AMOUNT FOUND DUE HIM FOR DAMAGES. IN VIEW OF THE CONTENTIONS ADVANCED THEREIN, WHICH ARE AT VARIANCE WITH EARLIER FINDINGS BY THE DEPARTMENT OF THE ARMY, THE CORRESPONDENCE WAS REFERRED TO THAT DEPARTMENT FOR A SUPPLEMENTAL REPORT. WE WERE INFORMED BY LETTER OF FEBRUARY 6, 1956, THAT ACTION HAS BEEN INITIATED TO OBTAIN ADDITIONAL INFORMATION FROM THE CHIEF OF ENGINEERS. WHEN THE SUPPLEMENTAL REPORT IS RECEIVED HERE DR. MANIGBAS' CLAIM WILL BE FURTHER CONSIDERED AND WE WILL BE PLEASED TO INFORM YOU OF THE ACTION TAKEN THEREON.
