TREASURY DEPARTMENT: REFERENCE IS MADE TO A LETTER OF APRIL 8. REGARDING A CONSIDERABLE NUMBER OF PENDING VESSEL-REPAIR ENTRIES COVERING VESSELS OWNED AND OPERATED BY THE UNITED STATES MARITIME ADMINISTRATION ON WHICH DUTIES ON THE COST OF FOREIGN REPAIRS HAVE BEEN OR WILL BE ASSESSED UNDER THE PROVISIONS OF SECTION 466. WHICH IS PROPOSING RETROACTIVE LEGISLATION AMENDING SECTION 466 OF THE TARIFF ACT SO AS TO RELIEVE VESSELS OWNED AND OPERATED BY THEM FROM PAYMENT OF THE INVOLVED DUTY. WE HAVE BEEN ADVISED INFORMALLY THAT THE PROPOSED LEGISLATION IS NOW BEING PREPARED IN THE MARITIME ADMINISTRATION AND WE CONCUR IN THE SUSPENSION OF EFFORTS TO DETERMINE AND EFFECT COLLECTION OF THE SUBJECT DUTY PENDING CONGRESSIONAL ACTION THEREON.

REFERENCE IS MADE TO A LETTER OF APRIL 8, 1955, FROM MR. D. E. STRUBINGER, ACTING COMMISSIONER OF CUSTOMS, REGARDING A CONSIDERABLE NUMBER OF PENDING VESSEL-REPAIR ENTRIES COVERING VESSELS OWNED AND OPERATED BY THE UNITED STATES MARITIME ADMINISTRATION ON WHICH DUTIES ON THE COST OF FOREIGN REPAIRS HAVE BEEN OR WILL BE ASSESSED UNDER THE PROVISIONS OF SECTION 466, TARIFF ACT OF 1930, AS AMENDED, 19 U.S.C. 257.

AT THE REQUEST OF THE MARITIME ADMINISTRATION, WHICH IS PROPOSING RETROACTIVE LEGISLATION AMENDING SECTION 466 OF THE TARIFF ACT SO AS TO RELIEVE VESSELS OWNED AND OPERATED BY THEM FROM PAYMENT OF THE INVOLVED DUTY, YOU INQUIRE WHETHER WE CONCUR IN (1) THE SUSPENSION OF EFFORTS TO EFFECT COLLECTION OF DUTIES DUE AND UNPAID AND (2) SUSPENSION OF EFFORTS TO SECURE INVOICES NECESSARY IN THE LIQUIDATION OF A NUMBER OF OLD ENTRIES TO DETERMINE THE COST OF FOREIGN REPAIRS AND DUTIES DUE.

WE HAVE BEEN ADVISED INFORMALLY THAT THE PROPOSED LEGISLATION IS NOW BEING PREPARED IN THE MARITIME ADMINISTRATION AND WE CONCUR IN THE SUSPENSION OF EFFORTS TO DETERMINE AND EFFECT COLLECTION OF THE SUBJECT DUTY PENDING CONGRESSIONAL ACTION THEREON. HOWEVER, IT IS ANTICIPATED THAT FINAL ACTION THEREON BY THE CONGRESS MIGHT NOT BE TAKEN DURING THE PRESENT SESSION.

ACCORDINGLY, WE HAVE NO OBJECTION TO THE SUSPENSION OF FURTHER EFFORTS BY YOUR BUREAU IN THIS REGARD UNTIL THE END OF THE 84TH CONGRESS.
