Availability of Appropriations for Grants to Eisenhower College

A decision was requested as to whether certain funds appropriated to the Department of the Treasury were available to make payments to the Eisenhower College and to the Sam Rayburn Library as grants under Public Law 93-441. The 1976 appropriation for a $1 million payment to the college based on percentages of the proceeds from the sale of $1 proof coins bearing the Eisenhower likeness "as provided by Public Law 93-441" must be construed as having a meaningful effect. Thus, since the only proceeds during the availability period of the appropriation will be from sales of $1 proof coins bearing a different design on the reverse side than that specified in Public Law 93-441, such proceeds may be used for payments to the College and the Library pursuant to the 1976 appropriation. The appropriation for payments to the College, contained in the Supplemental Appropriation Act of 1975 did not provide for availability beyond the fiscal year (FY) and, therefore, was not available for obligation in FY 1976.
