The Secretary of Agriculture requested concurrence in his refusal to pursue an overclaim established against the State of Florida for federal funds for the "especially needy" provided under the National School Lunch Program. Since the National School Lunch Act places the responsibility for determining eligibility for these funds on the states, there is no valid basis for the overclaim as long as the State Department of Education had data to reasonably support its conclusion that 21 school districts were eligible for the funds.
