Pursuant to a congressional request, GAO responded for the record to a portion of the statement submitted by the Chairman and the Chief Executive Officer of Beverly Enterprises, Inc. disputing GAO's determination that Beverly Enterprises, Inc. was a serious labor law violator.

GAO noted that the: (1) available facts support its identification of Beverly Enterprises, Inc. as a firm that met its criteria as a more serious labor law violator among all contractors with cases decided by the National Labor Relations Board (NLRB) during fiscal years 1993 and 1994; and (2) firm met the criteria to be characterized in GAO's report as a serious labor law violator because of its fiscal year 1993 case in which the NLRB applied a comprehensive Board-offered remedy, and its history of violators under the National Labor Relations Act.
