[Protests of HUD Solicitations for Due Diligence and Comprehensive Services]
Highlights
A firm protested two Department of Housing and Urban Development (HUD) solicitations for due diligence and comprehensive services, contending that: (1) HUD's use of the Small Business Administration's section 8(a) program to satisfy its needs was unconstitutional; and (2) HUD's issuance of one solicitation set aside for the 8(a) program and one solicitation for full competition was improper. GAO held that: (1) the protester failed to provide persuasive evidence which would constitute clear judicial precedent on the constitutionality or the legality of HUD's use of the section 8(a) program; and (2) HUD's parallel solicitations complied with federal acquisition regulations. Accordingly, the protest was denied.
