Highlights

A firm protested a Department of Justice (DOJ) contract award. As relief, the protester requested that DOJ reopen the solicitation and make award to the bidder based upon price and past performance. GAO held that: (1) the protest was academic, since DOJ had terminated the awardee's contract prior to this protest and was in the process of selecting another bidder for award; and (2) it is not GAO's practice to consider academic questions. Accordingly, the protest was dismissed.
