A firm protested a Department of Veterans Affairs (VA) contract award for home oxygen services, contending that VA: (1) had not impaneled an entirely new bid evaluation board based on a prior protest; and (2) improperly evaluated its proposal. GAO held that VA: (1) properly impaneled a new unbiased bid evaluation board; and (2) reasonably evaluated the protester's bid in accordance with the solicitation's evaluation criteria. Accordingly, the protest was dismissed.

We dismiss the protest because the protester, a not-for-profit entity, is not an interested party to challenge this sole-source award to an Alaska Native Corporation under the Small Business Administration's (SBA) 8(a) program.
