Highlights

A firm protested a Defense Logistics Agency (DLA) contract award, contending that the awardee could not meet the solicitation specifications. GAO held that the: (1) 6-month delay in responding to the protester's agency-level protest constituted initial adverse agency action; and (2) protester untimely filed its protest more than 14 calendar days after it knew of initial adverse action on its agency-level protest. Accordingly, the protest was dismissed.
