A firm protested a Navy contract award for facility interior and exterior painting, contending that the awardee could not perform certain work in accordance with applicable environmental laws at its proposed low bid price. GAO held that: (1) the protester did not present a valid basis of protest, since the Navy could accept the awardee's below cost bid; and (2) it would not review the Navy's affirmative responsibility determination. Accordingly, the protest was dismissed.
