Highlights

A firm protested a Department of Veterans Affairs contract award, contending that the awardee: (1) could not meet the solicitation requirements; (2) would not pay its employees appropriate wage rates; and (3) was not a small business. GAO held that it: (1) would not review the affirmative responsibility determination, since there was no evidence of fraud or bad faith; and (2) did not have the jurisdictional authority to review the awardee's size status. Accordingly, the protest was dismissed.
