An individual protested a Department of Agriculture contract award, contending that the contract specifications infringed upon its patent rights. GAO held that it would not consider the protest, since: (1) the protester untimely filed its protest after bid opening; and (2) it did not have authority to review allegations of possible patent infringements. Accordingly, the protest was dismissed.
