General Accounting Office is without jurisdiction to consider a protest of a procurement by the Clerk of the U.S. House of Representatives because the House of Representatives is not a federal agency for bid protest purposes. We dismiss the protest because we have no jurisdiction over procurements by the House of Representatives since it is not a federal agency as that term is defined by statute for bid protest purposes. Our bid protest jurisdiction is limited to procurements of federal agencies. 31 U.S.C. A federal agency is: "any executive department or independent establishment in the executive branch. Our Bid Protest Regulations provide that we "may consider protest concerning . . . procurements by agencies of the government other than federal agencies . . . where the agency involved has agreed in writing to have its protests decided by the General Accounting Office." 4 C.F.R.

DECISION

Court Reporting Services, Inc. protests the terms of an invitation for bids issued by the Clerk of the U. S. House of Representatives.

We dismiss the protest because we have no jurisdiction over procurements by the House of Representatives since it is not a federal agency as that term is defined by statute for bid protest purposes.

Our bid protest jurisdiction is limited to procurements of federal agencies. 31 U.S.C. Sec. 3551 (1988); 4 C.F.R. Sec. 21.1(a). A federal agency is:

"any executive department or independent establishment in the executive branch, including any wholly owned government corporation, and any establishment in the legislative or judicial branch, except the Senate, the House of Representatives and the Architect of the Capitol and any activities under his direction." 4 C.F.R. Sec. 21.0(c).

Nonetheless, Court Reporting Services, Inc. urges us to review this protest to ensure the integrity of the procurement bidding system.

Our Bid Protest Regulations provide that we "may consider protest concerning . . . procurements by agencies of the government other than federal agencies . . . where the agency involved has agreed in writing to have its protests decided by the General Accounting Office." 4 C.F.R. Sec. 21.11(a) (1994). The House of Representatives has not agreed to have our Office review its procurements.

Accordingly, the protest is dismissed.
