A firm protested a Department of Health and Human Services (HHS) contract award for facsimile machines, contending that: (1) HHS improperly eliminated the requirement that the machines interface with its computer network in making award to the awardee; and (2) it could have offered its equipment without the computer interface at a lower price than the awardee. GAO held that the protester was not sufficiently interested to protest, since, as a non-Indian firm, it was not eligible for award under the Buy Indian set-aside. Accordingly, the protest was dismissed.
