Highlights

A firm protested an Army contract award for linear-shaped charges, contending that the: (1) Army improperly waived first-article testing for the awardee; and (2) aggregate award to the awardee did not result in the lowest overall price to the government. GAO held that the protest was academic, since the Army removed certain items from the awardee's contract and awarded them to the protester based on its lower price. Accordingly, the protest was dismissed.
