A firm protested a Department of Defense (DOD) contract award for waste disposal, contending that the awardee: (1) intended to dispose of the waste at an unauthorized site; and (2) did not obtain the necessary disposal permits and licenses required to perform the contract. GAO held that it would not review the protest, absent a showing of possible fraud or bad faith on the part of procurement officials, since it involved a DOD affirmative responsibility determination. Accordingly, the protest was dismissed.
