PROCUREMENT - Bid Protests - Premature allegation - GAO review DIGEST: Protest alleging that agency may improperly cancel solicitation is dismissed since it is premature.

Brackett Aircraft Radio Company:

Brackett Aircraft Radio Company (BARCO) protests the cancellation of invitation for bids (IFB) No. DAAH01-91-B-A055, issued by the Department of the Army.

We dismiss the protest as premature.

Although BARCO alleges that it was informed during a telephone conversation with agency contracting personnel that the IFB is "in the process of being canceled," the agency advises that this is not the case. The agency explains that it became concerned that the IFB's technical data package may be insufficient, and has postponed bid opening indefinitely while it reviews the data package. Since the agency has not canceled the solicitation, Brackett's assertion that it will do so is speculative and premature. See Jantec, Inc., B-243192, Mar. 14, 1991, 91-1 CPD Para. 289. Consequently, there is no basis for us to consider the protest at this time.

The protest is dismissed.
