[Retired Navy Officer's Request for Waiver of Indebtedness]

A retired Navy member requested a waiver of his indebtedness for overpayments resulting from a miscalculation of his final pay, contending that he was unaware of the overpayments until the Navy notified him. GAO held that the claimant was: (1) not entitled to waiver of the remainder of the debt; and (2) partially at fault, since he should have known that payment of the entire amount of his regular active duty pay after he retired was erroneous. Accordingly, the request for waiver was denied.
