The Marine Corps requested a decision regarding whether a retired Marine Corps officer who was employed on a temporary basis by the Census Bureau was entitled to an exemption from the dual compensation laws following his appointment to the second of two temporary positions with the Marine Corps. GAO held that the retired member's appointment to another temporary position entitled him to a 30-day exemption from dual compensation restrictions under 5 U.S.C. 5532, but he did not qualify for the 6-month exemption from the Dual Compensation Act under Public Law 101-86. Accordingly, the claim was allowed in part and dismissed in part.
