Highlights

A firm protested a National Park Service (NPS) contract award for construction, contending that: (1) it did not materially alter its bid, since it had the surety's permission to change the original bid bond; and (2) the awardee's bid was nonresponsive, since its liability limit differed from the penal sum. GAO held that: (1) NPS properly rejected the protester's bid as nonresponsive, since the protester did not provide any evidence of the surety's consent; and (2) the protester was not sufficiently interested to challenge the award, since it would not be in line for award if its protest were sustained. Accordingly, the protest was denied in part and dismissed in part.
