A firm requested reconsideration of its denied protest against the Defense Logistics Agency's (DLA) unauthorized use of its proprietary drawing in a solicitation for plate seals. GAO had held that the protester failed to furnish sufficient proof to rebut DLA assertions that it had obtained rights to the data through its contributions to product and drawing development. In its request for reconsideration, the protester contended that: (1) it supplied sufficient proof that its drawing deserved trade secret protection; and (2) DLA contributions to product and drawing development were minimal. GAO held that the protester: (1) merely reiterated arguments it raised in its original protest; and (2) untimely supplemented its protest with information it could have submitted during the original protest. Accordingly, the request for reconsideration was denied.
