[Request for Decision Regarding Legal Fees Under EAJA]

The Military Traffic Management Command requested an advance decision regarding the propriety of the Armed Services Board of Contract Appeal's (ASBCA) decision requiring it to reimburse a firm for attorney fees and expenses under the Equal Access to Justice Act, contending that the fees and expenses were incurred by the firm's insurance carrier which was not entitled to such reimbursement. GAO held that it would not consider the request, since ASBCA decisions were not subject to its review. Accordingly, the request for a decision was denied.
