[Protest of VA Rejection of Bid as Nonresponsive]

A firm protested the Department of Veterans Affairs' (VA) rejection of its low bid for asbestos abatement, contending that the: (1) solicitation did not indicate that it needed to provide an approved Treasury listed corporate surety; and (2) it could substitute an acceptable Treasury-listed surety, since acceptance of its low bid would result in monetary savings. GAO held that: (1) VA properly rejected the protester's bid as nonresponsive, since it listed a surety that was not on the Treasury list; and (2) the protester could not cure its nonresponsive bid after bid opening. Accordingly, the protest was dismissed.
