PROCUREMENT - Bid Protests - GAO procedures - GAO decisions - Reconsideration DIGEST: Request for reconsideration was properly dismissed as untimely where it was filed more than 10 working days after the protester received the initial dismissal of the protest.

LightningMaster Corporation-- Request for Reconsideration:

LightningMaster Corporation requests reconsideration of our dismissal of its August 16, 1989, request for reconsideration of our August 1 dismissal of its protest.

We affirm the initial dismissal of the request for reconsideration.

Lightning's initial request for reconsideration, dated August 16, but filed on August 30, was dismissed because it was not filed at our Office within 10 working days after the basis of the request was known. 4 C.F.R. Sec. 21.12(b) (1989). The basis of the reconsideration request was the dismissal of Lightning's initial protest on August 1, 1989, which, in the absence of evidence to the contrary, we assumed was received within 1 calendar week of its issuance, or by August 8. See T-L-C Sys.-- Reconsideration, B-225496.2, July 28, 1987, 87-2 CPD Para. 97. In order for Lightning's request for reconsideration to have been timely filed, it should have been received at our Office by August 22, 10 working days after August 8.
