PROCUREMENT - Bid Protests - GAO procedures - Interested parties DIGEST: Fifth low offeror on a solicitation under which award was made to the lowest qualified responsible offeror is not an interested party under the General Accounting Office's Bid Protest Regulations to protest the qualifications of the low offeror, where protester does not also challenge the qualifications of the three intervening offerors.

A&R Janitorial Service Inc.:

A&R Janitorial Service Inc. protests award of a subcontract to Capital Services, Inc., by the Fermi National Accelerator Laboratory, which is operated for the United States Department of Energy. A&R contends that Capital did not meet the solicitation qualification requirements that it "demonstrate experience in the cleaning of areas of comparable square footage and types of services."

We dismiss the protest.

A&R is the fifth low offeror on this solicitation, under which award was made to Capital as the lowest qualified responsible offeror. Consequently, there are three intervening offerors, who are apparently responsible and have lower prices than A&R's. However, A&R has not protested that these offerors are not qualified for award or are otherwise unacceptable.

Consequently, A&R would not be in line for award if its protest were upheld. Therefore, A&R is not an interested party under our Bid Protest Regulations to protest that the low offeror is not qualified. General Electric Co., B-228465, Nov. 20, 1987, 87-2 CPD Para. 498.

Accordingly, the protest is dismissed.
