An Equal Employment Opportunity Commission (EEOC) employee appealed the denial of her claim for a retroactive step increase and backpay. The claimant contended that, since she had worked 39 hours per week with the Navy prior to a reduction in force, EEOC should have used her highest previous rate of pay in determining her current pay. GAO held that the claimant was not eligible for highest-previous-rate consideration, since: (1) she did not perform a regularly scheduled tour of duty; and (2) EEOC properly classified the claimant as an intermittent employee. Accordingly, the claim was denied.
