Nos. 99-500 and 99 661.

This responds to your letter of July 22, 1987, requesting our comments on a proposal to revise various sections of Federal Acquisition Regulation (FAR) Subpart 15.8 and the contract clauses at FAR Secs. 52.214-27, 52.215 -2, 52.215-22, and 52-215-23 to implement statutory changes enacted as section 952 of the Defense Acquisition Improvement Act of 1986, Pub.L. Nos. 99-500 and 99-661. This is FAR case No. 87-22.

The proposed revisions would (1) modify the definition of cost or pricing data, (2) preclude certain defenses to price adjustments for defective cost or pricing data, and (3) describe the circumstances under which offsets for understated cost or pricing data may be allowed, as well as the circumstances under which such offsets are prohibited. The proposed revisions accurately reflect the statutory changes, and we therefore have no objection to the proposal.
