The Equal Employment Opportunity Commission (EEOC) requested an advance decision regarding whether it should pay a permanent employee's share of his retirement contributions. EEOC had failed to deduct the employee's contributions from his salary after his change in status from reemployed annuitant to permanent employee. GAO held that there was no statutory authority allowing agencies to use appropriated funds for paying employees' shares of retirement contributions. Accordingly, the employee should pay his share of the retirement contribution, plus interest, to receive service credit.
