The Employment Standards Administration recommended that a firm and its two owners be placed on the ineligible bidders list for violations of the Davis-Bacon Act. The firm performed work as a subcontractor under an Army Corps of Engineers contract which was subject to minimum wage requirements. GAO found that the firm substantially violated the act because one of the owners intentionally underpaid the employees and falsified payroll records. GAO noted that there was nothing in the record to indicate that the other owner was involved in the violations since he severed his relationship with the company and dissolved the partnership. Accordingly, the firm and one owner, individually, will be included on the debarred bidders list.
