An individual requested reconsideration of the dismissal of his request for reconsideration of the dismissal of his protest. The prior request for reconsideration was dismissed because it was untimely filed. The protester contended that: (1) the first request for reconsideration was properly mailed; and (2) GAO failure to receive it must be attributable to the government's negligence, mishandling, or misdirection. Bid protest regulations require requests for reconsideration to be filed not later than 10 working days after the basis for reconsideration is known or should have been known. GAO found that the protester did not provide any evidence to show that the request for reconsideration was timely received and, GAO held that a protester makes use of the mail at its own risk and a delay in the mail does not serve as a basis for considering untimely filed materials. Accordingly, the prior decision was affirmed.
