A firm filed a complaint of a contract award for lumber and supplies. The solicitation was issued by a housing authority, and the contract was funded by a grant from the Department of the Interior. The protester alleged that the housing authority improperly rejected its bid as nonresponsive. Where a complaint has initially been filed with the grantee, GAO has held that the complaint must be filed with GAO within a reasonable time after the adverse agency decision. This protest was not filed with GAO until more than 2 months after the firm received the housing authority's denial of its initial complaint, which GAO did not believe constituted a reasonable time. Since the complaint was untimely, GAO would not consider it on the merits. Accordingly, the complaint was dismissed.
