A firm requested reconsideration of a decision which denied its protest of a Department of Energy (DOE) contract award for construction and demolition work. In the prior decision, GAO held that DOE reasonably permitted the awardee to correct a bid error. In its request for reconsideration, the protester alleged that the awardee was a large business, thus precluding it from the contract award. GAO noted that a request for reconsideration must contain a detailed statement of the factual and legal grounds upon which a reversal of the earlier decision is warranted. The focus of the protester's argument raised a new basis for protest. Therefore, since it has not identified any error of law or fact warranting reversal of the earlier decision, the request was denied. Further, despite the merits of the new and independent allegation, it was not filed in a timely manner and would not be considered.
