A Government employee requested reconsideration of a decision which held that the Bureau of Indian Affairs (BIA) had improperly authorized payment of per diem during his extended assignment to another location under the Intergovernmental Personnel Act. Upon reconsideration, GAO found that prior decisions and Office of Personnel Management directives did not give clear guidance to agencies concerning the limitations on their authority to authorize per diem for such assignments. Accordingly, GAO modified its prior decision in this case and stated that the employee was entitled to per diem at the maximum allowable rate, as authorized by BIA, while he was at the assignment site. However, GAO stated that the principles set out in the prior decision and recent Office of Personnel Management guidance should be followed for subsequent assignments under the Intergovernmental Personnel Act.
