A firm requested that the Government Printing Office (GPO) or GAO reimburse it for attorney's fees and costs incurred in pursuing a bid protest filed with GAO. The protester contended that GPO improperly determined that it was nonresponsible and refused to award it a contract under a GPO waste paper sale. The agency subsequently reversed its determination of nonresponsibility and awarded the contract to the protester. The protester contends that under applicable legislation it is entitled to reimbursement of the costs incurred in pursuing the protest. GAO is not subject to the Administrative Procedures Act (APA) and to recover under the Equal Access to Justice Act the claimant must have prevailed in an adversary adjudication under the APA. Accordingly, the protest was denied.
