A firm requested reconsideration of the denial of an earlier and untimely protest submitted in its actions against the the Air Force. Initially, the firm protested that the Air Force revealed misleading solicitation information concerning the contract in question which obscured the nature and scope of the contract requirements. This incident led the firm to ask for a bid opening postponement and a written clarification of the contract obligations. This request was denied by the contracting officer resulting in a protest by the firm. After receiving a negative response from the Air Force overruling the firm's action, the firm protested the matter to GAO. Although the exact date of the submittal and resubmittal of the protest was unclear between the parties involved, it was the opinion of GAO that the protest and the request for reconsideration were filed in an untimely manners. The firm failed to establish that the previous decision was based on an erroneous interpretation of either fact or law. Accordingly, the previous decision was affirmed.
