GAO was asked to determine the entitlement of a claimant to saved pay under the provisions of applicable legislation. The claimant was released from active duty in the Army Reserves at the rank of chief warrant officer and entered Officer Training School. While in school, he was paid as a staff sergeant. Upon completion of his training, he accepted a commission as a second lieutenant in the Air Force. The claimant subsequently requested payment of saved pay. GAO held that, under the revised language of applicable legislation, the claimant is entitled to saved pay as a warrant officer, notwithstanding the fact that he began officer training 6 days after being released from active duty in the Army and the fact that he was paid as a staff sergeant while attending Officer Training School.
