Proposed Contract Modification

The Department of the Interior requested an advance decision on whether to modify a contract with a firm to correct an allegedly mistaken bid. The mistake was alleged after bid opening but prior to the award of the contract. The firm submitted clear evidence that an error was made, how the error was made, and what the intended price should be. Since the amended price does not change the firm's low bidder status, the bid may be modified to reflect its actually intended net prices.
