Former employees of the Immigration and Naturalization Service asked GAO to reopen their claims that, for varying periods of time, they were improperly classified as intermittent rather than part-time employees. GAO had refused to consider the claims because the issues were pending before the Court of Claims. Since the Court denied the claims, the former employees asked GAO to consider the claims. However, a valid judgment of a court on a matter is a bar to subsequent GAO action on the matter. Accordingly, the claims were dismissed.
