A company requested reconsideration of a decision concerning a protest of a subcontract award by a firm that was a prime contractor to the Department of the Navy. The request for reconsideration was based on additional evidence, which was not received by GAO until after the decision had been signed. The evidence consisted of a letter, in which it was stated that the methods employed by the firm in selecting a subcontractor would be examined by the agency prior to approval of the subcontract award. A statement that the Navy would examine the firm's methodology for the selection of a subcontractor, prior to exercising its approval rights, does not establish that the Navy actively participated in the subcontractor selection process so as to invoke GAO bid protest jurisdiction. Accordingly, the prior decision was affirmed.
