A firm protested the award of a contract by the Navy. Subsequent to filing its protest, the protester also sought a temporary restraining order, a preliminary injuction, permanent injunctive relief, and a declaratory judgment in a U.S. district court. The grounds presented as the bases for the suit are the same as those presented to GAO in support of the protest. It is the policy of GAO not to decide protests where the material issues are before a court of competent jurisdiction unless the court requests, expects, or otherwise expresses an interest in a GAO decision. The court has not expressed interest in a decision, nor has the protester sought such an expression from the court. Therefore, the protest was dismissed.
