Request for Reconsideration of Bid Rejection

A protester requested reconsideration of a GAO decision which denied his protest. The agency rejected the protester's bid because the bid included a statement which limited the agency's right to issue an effective notice to proceed as it saw fit and thereby limited the completion date of contract performance. GAO agreed with the agency decision. A request for reconsideration must contain a detailed statement of the factual or legal grounds which allegedly warrant reversal of a decision and must be submitted within 10 working days after the basis for reconsideration is known. The protester did not submit any facts, arguments, or points of law which were not previously considered by GAO. Therefore, his request provided no basis for consideration. As the request was received by GAO more than 10 working days from the time the protester should have received the prior decision, its timeliness was questioned. The request for reconsideration was denied.
