An agency requested a GAO decision concerning an employee's entitlement to compensation for time worked after the expiration of his temporary appointment and before his appointment to a permanent position. The agency reported that the limitation was exceeded because the employee worked a considerable amount of overtime and his time was not monitored as it was expected that he would receive a permanent appointment. The agency also asked for a confirmation of its determination that annual and sick leave could not be credited for that period. GAO concluded that the excess time worked was due to an administrative error and not the fault of the employee; thus the employee was entitled to be paid for the hours he worked in excess of the limitation of his appointment. The employee was not entitled to leave credit for that period.
