A firm protested that an invitation for bids issued by the Department of Agriculture contained unduly restrictive specifications. The firm also sought injunctive relief before a court of competent jurisdiction. The court denied the protester's requests for relief and entered a judgment for the defendant on the merits of the case. Where a protest has been decided on the merits by a court of competent jurisdiction without expecting or requesting an opinion from GAO, it has been the policy of GAO to dismiss the protest. Accordingly, the protest was dismissed.
