A firm requested reconsideration of a decision which denied its protest alleging that a solicitation for technical services was improper because it did not include provisions for logistic support to contractor personnel. The firm contended that GAO misunderstands the basic concepts of logistic support in that it is not given to contractors but offered in exchange for lower prices by the contractor. It further alleged that there was no evidence to justify precluding logistic support under the contract. GAO recognizes that the provision of logistic support is the responsibility of military commanders who are given authority to control access to resources and to manage resources. In considering the discretionary nature of logistic support contract provisions, GAO found that the evidence supported the contracting officer's decision. The firm did not advance facts or legal arguments which showed the prior decision to be erroneous. Therefore, the prior decision was affirmed.
