Rejection of Proposal for Failure To Offer Rental-To-Purchase Conversion Privilege

The protester objected to the fact that the General Services Administration (GSA) insisted on purchase options as a condition for award of an automatic data processing (ADP) schedule contract. The request for proposals (RFP) itself did not impose the purchase requirement and prior contracts had been awarded by GSA on a rental basis only; nevertheless, these conditions did not preclude GSA from insisting on purchase options during the present negotiations. Records showed that the protester was informed that a final and best offer, including reasonable purchase prices, must be received by GSA or the protester's offer would be evaluated as presented. The protester chose not to comply, and the protest was denied.
