Community Services Administration Employee Claim for Pay at Higher Rate

A rehired employee of the Community Services Administration (CSA) claimed that upon reemployment she should be paid at the GS-5, step 10, rate rather than at the GS-5, step 6, rate that she received when she had previously worked in the same position. She claimed that she was assured by her supervisor that she would be paid at the GS-5, step 10, rate, and her supervisor endorsed her position and stated that he had hired her with this understanding. The employee asked that equitable relief be granted her. According to regulation, however, an agency may not pay an employee upon reemployment at any rate of his grade which exceeds his highest previous rate. The employee's claim for pay at a higher rate was therefore denied.
