Highlights

A protester to a contract award contended that the awardee's bid should have been rejected as nonresponsive for failure to include certain information. The bid was not considered nonresponsive since the information did not relate to a commitment to the agency's needs but to the bidder's ability to perform and may be submitted after bid opening. A sample requirement in the solicitation, for use in determining bidder responsibility, should have been levied only upon the bidder in line for the award. This deficiency was called to the attention of the agency.
