Contention That Awardee Did Not Compete on Equal Basis

A protester contended that the awardee of an army contract for oxygen systems should have been rejected as nonresponsive and did not compete on an equal basis. Although the awardee's offer did deviate from the solicitation dimensions, the items offered complied materially, and the army permitted the minor deviations. The contention that the solicitation was restrictively drawn to give the awardee an advantage was not a matter for consideration by GAO.
