Request for Additional Compensation under Timber Sale Contract

An agency requested a decision as to whether a contractor for the purchase of timber and construction of an access road was entitled to be paid for the additional cost expended in performance of the contract. The contractor was entitled to the additional compensation since the parties entered into the contract on the basis of a mutual mistake as to the amount of excavated material to be hauled.
