The protester alleged that the successful bidder failed to comply with the terms of the invitation for bids, which allegedly required each bidder to submit with its bid a certification letter for the specific Type III marine sanitation devices offered. The protest was denied since the invitation for bids only required, and the successful bidder submitted, a copy of the certification letter for any Type III device. The applicable statute and regulations covering the devices required did not affect the responsiveness of the bid.
